Called to Order at 7:30 PM under M.G.L. c 131, §40 and the Hanson By-Law 3-13, §5 and Rules and Regulations by Philip R. Lindquist, Chairman, in Meeting Room A at the Town Hall.

The minutes of July 27, 2010 and June 30, 2010 were postponed until 8/24/10 for revisions.


Public Hearings

7:30 PM Continued Notice of Intent for a proposal to control aquatic nuisance vegetation by the Town of Halifax to treat the algae in the eastern and western basins of Monponsett Pond utilizing low-dose treatments of aluminum sulfate (alum), to preclude severe algae blooms and to lessen the likelihood of toxic algae blooms  (DEP #SE175-0580)

Appointments

7:30 PM Appointment with Larry Lundin of Hanson Fuel and Eli Youseff, owner regarding the installation of a septic system at 1158 Main Street.

Mr. Vacca gave an overview of the situation to the Commission.  It was brought to his attention  that a septic system had been installed at the above mentioned address.  Subsequently, Mr. Vacca found that the owner Mr. Youseff had installed a new system after receiving Board of Health approval.   However, a Conservation Blanket Permit issued to Mr. Al Vautrinot of Vautrinot Land Surveying was for “test pits only” and had expired last year in 2009.   The BOH plan dated 2006 showed the system as 53’ from an adjacent resource area.  Mr. Vacca directed Mr. Vautrinot to have the wetlands re-delineated and provide the Commission with an as-built to show whether the system was constructed within the 50-foot buffer zone.

7:45 PM  Appointment with John Barrows, P.E. of Marchionda & Associates, L.P. to discuss a one-year Extension for an Order of Conditions for Stonebridge Commons (DEP #SE175-396)

Mr. Barrows, representing Pulte Homes updated the Commission as to the status of the construction of the project.  Pulte has constructed three new buildings, two of which are outside of jurisdiction.  They are complete except for grading and final landscaping, after which Mark Ridder will take over the project.  Mr. Ridder has already started Phase II by installing erosion control and clearing.  Mr. Vacca suggested that at some point in the future, a meeting is scheduled to look at the wetland line and the 2nd Phase of the project.

Mr. Schellenger read the Public Hearing Notice and the abutters were verified.  Mr. Steve Wry made the presentation for the roadway drainage.  Because the previous Order of Conditions had expired (DEP #SE175-0478), a Certificate of Non Completion was issued.  Mr. Wry reminded the Commission that a new Order of Resource Area Delineation was issued in the Spring and was incorporated into this plan.  The roadway is 80% complete with the exception of two detention basins both within 100 feet of the BVW but outside the 50-foot no disturb zone.  Mr. Wry commented that the Board of Appeals had approved the stormwater calculations in the context of the previous filing.  Mr. Schellenger inquired as to who did the independent review of the calculations and did documentation exist.  No abutters were present.

Motion to continue to 8/24/10 at 8:15 PM to find out who did the review, their qualifications and review of the calculations:  Frank Schellenger  
Mr. Lindquist requested a recorded deed with a right to pass over for an easement into the conservation property out back.   Mr. Schellenger also mentioned that the applicant consider a conservation restriction for the remainder of the undeveloped land.

8:15 PM  Request for an Amendment to an Order of Conditions for a minor modification to the approved septic plan for 430 Liberty Street (Shaw’s Plaza), Maps 73, 81 & 82, Lot 7 for NP Hanson, LLC c/o Northstar Centers, LLC represented by H. Thomas French, Jr., Land Use Consultant, 20 Gilbert Street, Mansfield, MA  02048 (DEP #SE175-0569)  (New Hearing)

Frank Schellenger read the Public Hearing Notice and the abutters were verified.  Tom French made the presentation for an Amendment to an Order of Conditions that was issued about a year ago for a septic remediation to alleviate groundwater.  During test pit inspection, remnants of an old abandoned clay pipe leaching field were found.  After meeting with the Board of Health, it was determined that the old scenario wasn’t feasible anymore and an entirely new septic system was designed outside of conservation jurisdiction.   Mr. Vacca recommended approval and suggested that at the pre-construction meeting, the conditions be pared down to reflect the new plan.  No abutters were present.

Because the State Primary is being held on September 14h, the meeting for that date was rescheduled for September 7th.

Act Relative to Economic Development Reorganization
Mr. Vacca reported that the Tax Holiday bill included a 2 year extension for all permits issued between the dates of August 15, 2008 and August 15, 2010.  The bill was to stimulate recovery for developers hard hit by the economic slump.  More details will follow.


Enforcement

Mr. Vacca reported an enforcement issue that was dealt with today.  He was alerted by concerned residents and after an inspection found that the owner of a parcel for sale on Pleasant Street had contracted with Glen Tree Service and cut a 200’ long walkway for prospective buyers within 100 feet of an isolated wetland and through a vernal pool.  Mr. Vacca will issue an Enforcement Order and a fine.  The owner will be required to hire a wetland scientist and prepare a restoration plan.
